TERMS & CONDITIONS

These Terms and Conditions have been designed to provide Clients with all the relevant information required to facilitate the booking process with St Anton 365. We are always happy to discuss  any questions you may have via telephone on +43 (0) 660 540 3000 or via e-mail, addressed to carly@stanton365.com.

These booking conditions apply to all holidays booked with St Anton 365.

“St Anton 365” is legally registered in Austria (company no: LA-GISA 33971315/3-2021), licenced to trade at Gassli 1, St Anton am Arlberg, 6580. (Referred to in this document as “us” or “we” or “St Anton 365”)

“The Client” means all persons included in the booking (represented by the Party Leader and named on the Booking Form within ten weeks of departure) including anyone who is added or substituted at a later date. (Referred to in this document as “the Client” or “you” or “your”).

“The Party Leader” refers to the individual who makes the booking on behalf of the Client.

“Our services” are those services provided by St Anton 365 directly, such as food and accommodation. All other services provided by external suppliers, such as, but not limited to, third party transfers, childcare, ski lessons, ski-hire and lift passes, are not classed as part of “our services”, even if booked on The Client’s behalf by St Anton 365.

  1. Quotation
    • All prices published or quoted are in Euros (EUR). All written quotations are valid for a period of fourteen days from the date of issue. Errors in costing are extremely rare, but should there be an obviously incorrect price, we will issue a new quotation and we will not be bound by the incorrect amount quoted.
    • Any prices shown in another currency are for conversion rate comparison only. The Client must be aware that conversion rates fluctuate and that St Anton 365 holds no responsibility for these fluctuations. All prices are agreed in Euros.
    • St Anton 365 reserves the right to increase or decrease the accommodation prices published on the internet or quoted at any time. We do however guarantee that once we have confirmed your booking the price is fixed unless you wish to amend the booking.
  2. Your holiday contract with St Anton 365
    • You must read these booking conditions carefully before booking your holiday with St Anton 365. The Party Leader accepts the booking conditions on behalf of all persons within the Client party. It is the Party Leader’s responsibility to bring these booking conditions to the attention of all persons included in the booking.
    • We reserve the right to change our booking terms and conditions without notice. If you have already booked a holiday before any changes you have the option to stay with the booking terms and conditions from your booking date. You will be notified in writing of any proposed change and you must accept or refuse this within 28 days. If you make no contact then it is taken as you have accepted the new booking terms and conditions.
    • The contract is made on the date we issue your booking confirmation. No contract or obligation exists before this date. The booking confirmation will be issued when St Anton 365 is in possession of a deposit payment or full payment of the total holiday cost (as applicable). Detailed in Clause 3.
    • Your booking of a holiday with St Anton 365 confirms you understand and accept all terms and conditions laid down in our “Booking Terms and Conditions”.
    • When you receive your confirmation invoice, please check all the details carefully to ensure that they are correct. If there are any discrepancies in the confirmation invoice, please bring these to our attention within 7 days of issue, otherwise we will assume that the details shown are correct.
    • This contract does not apply to any services not classed as part of “our services”, such as childcare, ski lessons, ski hire and lift passes. We have no liability or obligation in relation to these services.
  3. Booking, deposits and payments for services provided by St Anton 365
    • A non-refundable deposit of 25% of the total holiday cost is required at the time of booking. The submission of the booking form by the party leader signifies an acceptance of these terms and conditions by all group members.
    • St Anton 365 will issue confirmation of your booking when the full deposit and booking form have been received and cleared. Only from the date of this booking confirmation does any contract or obligation exist between St Anton 365 and The Client.
    • The Final Balance, along with any additional agreed extras, is due 10 weeks prior to your arrival (Balance payment date).
    • For bookings made within 10 weeks of arrival, the deposit and final balance are both due on booking.
    • The Party Leader will be liable for full payment for all persons in the Client party and for any other persons added or substituted at a later date. If payment has not been received by St Anton 365 by the Balance Payment Date, we will have the right to cancel the booking and retain the deposit, and re-sell the holiday without notice. (In reality St Anton 365 will make every effort to contact The Client and only cancel your holiday without notice if we have been unable to make contact).
  4. Third Party Services
    • We may make bookings on your behalf with third parties (for example ski schools, ski hire providers, the lift pass office, childcare providers, restaurants and transfer companies). All third party bookings are subject to the terms and conditions of the provider. All contracts made are between you and the third party provider. We do not enter into any contract with third parties, and do not have obligation for any matter arising from a third party provider. We do not offer any comment on the standard of services they may provide. All disputes must be taken up with the provider directly, including requests for refunds, even if we have paid the supplier on your behalf.
    • Bookings will be made on your behalf on the basis of the information you supply (e.g flight times for airport transfers). If the information supplied is incorrect you will be billed for any charges incurred by St Anton 365.
  5. Booking amendments and cancellations
    • You may request alterations to your booking and proposed itinerary at any time prior to your departure. In such occasions St Anton 365 will do everything we can to try to accommodate you. Any requests shall not be taken to form part of the contract until any additional costs have been paid by The Client, and the alteration has been confirmed in writing by St Anton 365.
    • If you decide to cancel your holiday, you should let us know immediately in writing by email or letter. The date of the cancellation will be deemed as the date we receive the email or letter. If you cancel your holiday for any reason a cancellation charge is due as stipulated below. Please ensure your insurance covers cancellation of your holiday for any reason.
    • If the client does not arrive in resort or at the airport (as applicable), without the prior knowledge of St Anton 365, your holiday will be cancelled without notice and the below charges apply.

Cancellation charges:
10 or more weeks prior to arrival          25%of total holiday cost(loss of deposit)

4 – 7 weeks prior to arrival                    75% of total holiday cost
4 or less weeks prior to arrival              100% of total holiday cost

  1. Changes or cancellation by St Anton 365
    • In exceptional circumstances it may be necessary for St Anton 365 to cancel a confirmed holiday. We must reserve the right to do so. In the very unlikely event we need to make a cancellation for reasons not classed as “force majeure” then we will offer you a full refund of all monies paid. We accept no legal liability and will pay no compensation.
    • In the case of us making a major alteration to your holiday, you may select either a full refund of all monies paid or the altered holiday offered by us. Change of dates or removal of exclusive use of the chalet are classed as major alterations. All other alterations, including change of room, are classed as minor alterations and no offer of refund is applicable.
    • The refund of all monies paid is the full limit of our liability, we accept no liability for any other costs incurred to you, including charges for cancellation of your travel and cancellation of other services, for example ski hire, ski lessons, lift passes and childcare.
    • In the case of alteration to, or cancellation of your holiday due to force majeure then no refund will be given. Force majeure is unusual circumstances outside our control, including, but not limited to, war, threat of war, terrorist action or threatened terrorist action, riots, industrial action, natural or nuclear disasters, health epidemics/pandemics, fire, flooding or adverse weather conditions, closure of ports and airports, closure of borders/international travel restrictions or similar events.
  2. Insurance
    • It is a condition of booking that all guests must have adequate personal travel insurance for their holiday, to include adequate liability for the following:
      • Emergency medical expenses to include mountain rescue, ambulance charges and repatriation costs.
      • Winter / summer sports insurance to cover any and all activities that you may undertake in resort.
      • Cancellation or curtailment of your trip.
      • Travel and transfer delays and cancellations.
      • Third party risks and costs incurred from damage to property or adjacent properties during your stay caused by you or any member of your party, your employees or your visitors to the property.
      • Holiday cancellation due to illness / emergencies / medical reasons.
  3. Your responsibility to St Anton 365
    • Whilst on a holiday with St Anton 365, you promise to behave in an acceptable manner which does not threaten the condition of the chalet or disturb the enjoyment of other guests or neighbours.
    • St Anton 365 does not charge a deposit, however reserve the right to charge The Client for any damage to our property and for any unusual cleaning. This must be paid within 24hrs else we reserve the right to terminate this contract and all services we provide to you, including accommodation, food and transfers.
    • For the comfort of our guests and for safety reasons, we would like to remind our guests that the chalet is exclusively non-smoking. Guests who wish to smoke may do so outside in designated areas.
    • It is the condition of every booking that each member of your party is covered by personal insurance as stated in Clause 7.
  4. Our responsibility to you
    • We promise that our website information is correct to the best of our knowledge at the time of writing. Information relating to the resort and prices for additional services can change and we will make every effort to inform you of these if they occur.
    • We take no responsibility of any actions or omissions of St Anton 365 personnel outside normal working times, including voluntary skiing and socialising with guests.
    • We take no responsibility for any persons not employed St Anton 365, even if they are a third-party supplier connected to us.
    • We have in place health and safety systems required by Austrian law, however we must remind our Clients to act with reasonable due diligence and care at all times. 
  5. Weather
    • Despite the best efforts of St Anton 365, temperature and weather conditions in the Mountains can be unpredictable and challenging. We do not always guarantee that ice and snow can instantly be removed from all areas around the chalet and accept no liability for accidents/injuries occurring under such circumstances.
    • The risk of your holiday being adversely affected by weather conditions has to be accepted. St Anton 365 shall not be liable for any loss, delay or costs connected with, or arising out of, adverse weather conditions, including blocked roads, missed flights and airline delays. If you miss your return departure and extra accommodation or alternative travel arrangements are required, we will not be responsible for this cost. 
  6. Chalet facilities
    • We make every effort to ensure that all advertised chalet facilities are in full working order. In the event of their failure all efforts will be applied to ensure continuous provision of these facilities. In a mountain resort it can take longer to rectify any problems that may occur than you might expect in the U.K., especially involving trades persons and during the holiday periods. Please bear this in mind when we are dealing with any issues. However no down-time of any of the above will constitute any refunds if circumstances are outside our means.
  7. Additional payments
    • Upon request, St Anton 365 will make purchases on your behalf both before and during your holiday. Any such purchases shall be paid in full prior to departure from the chalet.
  8. Check-in / check-out
    • The chalet will be available for you from 16:00 (4pm) on your day of arrival.You are required to vacate the property by 10:00 (10am) on your departure day (unless otherwise agreed). Please do inform us if your arrival and departure is outside of these times and we will do our very best to accommodate you.
  9. Lost or stolen property
    • In the event that guests lose property while on holiday, or leave items in the chalet when returning home, no responsibility will be accepted by St Anton 365 in the event that the property is not recovered or returned. St Anton 365 cannot accept any responsibility for theft from the chalet or at any other time during your holiday. Postage and packing will be charged for the return of left items.

COVID-19 POLICY FOR WINTER 2021/2022

If, in the 7 calendar days prior to the start of your holiday with St Anton 365, your holiday is unable to go ahead due to one of the Covid-19 reasons listed below, you will be entitled to a credit note for 100% of the payments you have made, to be used up until the end of the 2022/2023 winter season.

  1. The Austrian authorities impose regional or national restrictions which result in the closure of the Austrian border to non-residents.
  2. All ski lifts in the resort are closed due to coronavirus restrictions imposed by the Austrian authorities.
  3. An instruction by the local authorities in Austria to close our chalets as a result of Covid-19.
  4. The party leaders home country impose travel bans to Austria.
  5. You would be required by the Austrian authorities to quarantine / self-isolate in Austria on arrival for more than 24 hours.

The above reasons must be in place and effective at the time your holiday is due to take place.

In no circumstances are we responsible for any other expenses including without limitation, the cost of flights or any other form of transport.
